Terms of use
The terms on which you may use this website. They are not the terms of any service contract.
On this page
1. Who these terms are with
This website, modulartechs.org, is operated by Modular Tech Support Ltd, a private company limited by shares registered in England and Wales under company number 16687194, whose registered office is 18 Luscombe Close, Woodlands, Ivybridge, England, PL21 9TT. In these terms, "we", "us" and "our" mean that company; "you" means the person using the site.
2. Accepting these terms
By using this website you accept these terms. If you do not accept them, please do not use the site. We recommend printing or saving a copy for your records.
3. What this website is for
This site describes the IT services we offer and how to contact us. It is general information, not technical, legal or professional advice, and nothing on it should be relied upon as advice about your particular systems. IT environments differ; the right answer for your organisation needs to be established by looking at it.
Nothing on this website is an offer capable of acceptance. Descriptions of modules, response targets, coverage areas and ways of working are indicative. A binding agreement arises only when we have agreed a specific scope and price with you in writing.
4. Service terms are separate
These terms govern use of the website only. Any work we do for you is governed by the separate written terms, quotation or engagement letter agreed with you before that work begins. Where those documents conflict with anything on this website, those documents prevail.
5. Intellectual property
All content on this site — text, layout, design, graphics, logos, icons and code — is owned by or licensed to us and is protected by copyright and other intellectual property rights.
You may view the site, and print or download extracts for your own personal or internal business use. You may not republish, redistribute, sell, or exploit any part of it commercially, nor remove any copyright or proprietary notices, without our prior written permission. Our name, logo and brand marks may not be used without permission.
6. Acceptable use
You agree not to:
- use the site in any way that breaks any applicable law or regulation;
- attempt to gain unauthorised access to the site, its server, or any connected system;
- introduce malware, or attempt any denial-of-service or similar attack;
- scrape, harvest or systematically extract content, including addresses for unsolicited marketing;
- use the site in any way that damages it, or impairs anyone else's use of it.
We report serious misuse to the relevant authorities, and will co-operate with them in disclosing your identity where required.
7. Availability
We provide this website free of charge and give no guarantee that it will always be available or uninterrupted. We may suspend, withdraw or change any part of it without notice. We are not liable if the site is unavailable at any time or for any period.
8. External links
Where we link to other websites, those links are provided for information only. We have no control over the content of those sites and accept no responsibility for them or for any loss arising from your use of them.
9. Liability
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
Subject to that, and to the fullest extent permitted by law: the site is provided "as is" without warranties of any kind; we exclude all implied conditions and warranties relating to it; and we are not liable for any loss of profit, loss of business, business interruption, loss of data or loss of anticipated savings arising out of or in connection with the use of, or inability to use, this website.
This clause does not affect any liability arising under a separate written service agreement between us, which is dealt with in that agreement.
10. Privacy and cookies
How we handle personal data is set out in our privacy policy. This site sets no cookies; see our cookie policy for the detail, including the one third-party request the site makes for typefaces.
11. Changes to these terms
We may revise these terms at any time by amending this page. Please check it from time to time; the date at the top shows when it last changed. Continuing to use the site after a change means you accept the revised terms.
12. Governing law and jurisdiction
These terms, their subject matter and their formation are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, save that if you are a consumer resident elsewhere in the United Kingdom you may also bring proceedings in the courts of the part of the UK in which you live.
13. Contact
Questions about these terms should be sent to info@modulartechs.org, or by post to Modular Tech Support Ltd, 18 Luscombe Close, Woodlands, Ivybridge, England, PL21 9TT.
